We need your help in urging Congress to OPPOSE the Insurance Fraud Accountability Act (US S 976/H.R. 2079), which fails to address the root causes of fraud in the ACA marketplace and instead unfairly targets licensed agents and brokers who help millions of Americans access quality healthcare. Let your legislator know TODAY the real consequences of this legislation and how main street Americans will be negatively impacted.
The primary threat to the Marketplace is not ethical brokers but call centers and private firms that exploit regulatory gaps: particularly through Enhanced Direct Enrollment (EDE) pathways. These entities use their technical infrastructure to mass-enroll consumers, often without consent or by manipulating income data to maximize APTC eligibility.
This bill takes a one-size-fits-all approach to regulating the ACA marketplace, unfairly targeting agents and brokers who advocate for their clients, by permitting the government to audit agents based on enrollment patterns that so much as suggest fraud. Brokers like you who diligently support their clients will be unnecessarily burdened by this legislation.
The provisions of this legislation do not enact any real reforms that will combat fraud in the ACA marketplace. NABIP has consistently advocated for safeguards for the ACA marketplace to ensure that cybercriminals do not have access to sensitive patient information, including implementing two factor authentication to protect consumer data. Instead, this bill will only create unnecessary red tape for agents, while allowing criminals to continue to commit fraud.
